Terms and Conditions

These terms govern your use of the Tempo app for iPhone, Apple Watch and Mac, and of this website (together, the "Service"). By downloading, installing or using Tempo you agree to these terms. If you do not agree, please do not use the Service.

1. Who we are

Tempo is developed and published by an independent developer ("we", "us"). You can reach us through the Get in touch option in the app's Settings tab or through the links at the bottom of this page.

2. Licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Tempo on Apple devices that you own or control, in accordance with the usage rules set out in Apple's Media Services Terms and Conditions. You may not copy, modify, distribute, sell, lease, reverse engineer or attempt to extract the source code of the app, except where applicable law expressly permits it.

3. Subscriptions and purchases

Some features of Tempo ("Premium") require a paid subscription or a one-time purchase, billed through your Apple ID. Prices are shown in the app before you buy and may vary by region.

We may change prices or the features included in Premium. Changes to the price of an existing subscription take effect only at the next renewal and only after Apple has notified you.

4. What Tempo does and does not do

Tempo listens to your voice while a session is running and gives feedback on pace, pauses, filler words and related aspects of delivery. This feedback is generated automatically and is offered for practice and self-improvement only. It is not professional coaching, medical, speech-therapy or other advice, and it may be inaccurate. You are responsible for how you use it.

5. Your content and recordings

Transcripts, recordings and practice results are yours. By default they stay on your device, and they sync between your own devices only through your private iCloud account when you enable that. We do not receive your recordings or transcripts. You are responsible for making sure you have the right to record any speech that includes other people.

6. Acceptable use

You agree not to use the Service in any way that is unlawful, that infringes the rights of others, that interferes with the operation of the Service, or that attempts to gain unauthorised access to any part of it.

7. Privacy

How Tempo handles data is described in the Privacy section of this website and in the privacy details shown on the App Store. In short: speech is processed on your device or by Apple's speech services, and we collect only anonymous usage analytics and, with your permission, advertising attribution data.

8. Intellectual property

Tempo, its name, icon, design, drills, practice passages and all related content are owned by us or our licensors and are protected by copyright and other laws. Nothing in these terms gives you any right to use our name or branding.

9. Third-party services

Tempo relies on services provided by Apple, including speech recognition, iCloud and the App Store, and on third-party analytics and subscription infrastructure. Those services are subject to their own terms, and we are not responsible for their availability or conduct.

10. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free or that the feedback it gives will be accurate.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for it in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited under applicable law, including your statutory rights as a consumer.

12. Termination

You may stop using Tempo at any time by deleting the app. We may suspend or end your access to the Service if you breach these terms. Sections that by their nature should survive termination, including sections 8, 10 and 11, continue to apply.

13. Changes to these terms

We may update these terms from time to time. The date at the top shows when they were last changed. If a change is material we will tell you in the app or on this website before it takes effect. Continuing to use the Service after a change means you accept the updated terms.

14. Governing law

These terms are governed by the laws of the country in which the developer is established, without regard to conflict-of-law rules, and any dispute will be heard by the courts of that country, except where mandatory consumer protection law in your country of residence gives you additional rights.

15. Apple

These terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for Tempo and is not responsible for addressing any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
